What does contract to hire mean?

Contract to hire is an arrangement in which a person starts in a role as a contractor or temporary worker for a set period, often through a staffing agency, with the intention that the employer may offer them a permanent job at the end.

What does contract to hire mean?

During the contract period the person is usually employed or engaged by the staffing agency, which handles their pay, while they work day to day for the client company. Contract periods are commonly a few months. At the end the client decides whether to convert them to a permanent employee, extend the contract or end the assignment. Agency agreements often include a conversion fee if the client hires the person directly, so check the terms before the first day.

Employers use contract to hire to see someone do the real job before committing, to fill a role quickly while budget for a permanent position is confirmed, or to manage uncertain demand. It is common in IT, engineering, finance and operations roles in the US and India.

The trade-offs fall mostly on the candidate side, which affects who applies. Strong candidates with permanent offers elsewhere may not accept a contract role, benefits during the contract may be thinner, and people who are kept on long contracts without a decision tend to leave. If you use contract to hire, say in the advert that it is contract to hire, state the likely length and the criteria for conversion, and make the decision on time.

Watch the legal status. Whether the person counts as an employee, a worker or self-employed depends on the facts of the arrangement and the country, and the rules on agency workers and misclassification differ. Treat the contract period as the probation it effectively is, with clear goals and a review before the decision. This is general information, not legal advice.

Example

A US company hires a data analyst on a six-month contract-to-hire basis through a staffing agency. Her goals are agreed in week one, she has reviews at months two and five, and at month five the company offers her a permanent role, paying the agency’s agreed conversion fee.
